Welcome to the website and apps of yourtravis.com!

TRAVIS Road Service Netherlands B.V. (“TRAVIS”), Dr Hub van Doorneweg 183, 5026RD Tilburg, the Netherlands, welcomes you (the users of our website and apps) on our website www.yourtravis.com and mobile apps. By connecting to or using the website and/or apps, you automatically confirm, without limitation or reservation, that you have read, understood and accepted these ‘General Terms and Conditions’ of Use and the ‘Privacy Statement’.

If you do not or no longer agree to these terms and conditions, you may no longer use our internet pages and apps.

Contractual relationship, validity and responsibility

TRAVIS Road Services Netherlands B.V. (also “we” or “us”) is responsible for TRAVIS’ internet pages (also “website” or “internet portal”) on the domain yourtravis.com and mobile apps (also “app” or “TRAVIS app”) accessible via Apple App store or Google Play Store.

The use of TRAVIS’ websites and apps (together “our domains” or “its domains”) is subject to the ‘General Terms and Conditions of Use’, provided that no mandatory legal provisions apply.  In individual areas protected against access or if we have agreed otherwise with you (or with a third party on whose behalf you are acting) in individual cases, additional or special conditions may apply which take precedence over these ‘General Terms and Conditions of Use’.

The mere use of our domains does not give rise to any assignment, employment or employment relationship between you and TRAVIS, regardless of how it is formulated.

TRAVIS presents information and/or documents (content) on its domains, which you can read or download. If no payment obligation is indicated for specific services, we offer our service free of charge (of course, you bear the costs of the connection and devices to gain access).

Registration and login

Some areas of our domains can only be accessed with a password after registration. There is no right to such registration (in order to gain access to these areas) against TRAVIS. We can protect, including until now freely accessible parts of our domains, at any time by means of a login.

TRAVIS reserves the right to revoke any access authorisation granted to you at any time and with immediate effect, without having to justify this, in particular if you are:

  • (have) violate(d) the agreed User Conditions,
  • (have) violate(d) your duties of care in handling the login details,
  • act/have acted with malicious/fraudulent intent, or
  • have not used the access-protected area for a longer period of time.

In connection with a registration, you and TRAVIS agree on additional conditions, referred to separately in the registration process.

In our ‘Privacy Statement’ you can read how we handle data, what data we collect, process and store and how we protect it.

Rights of use and intellectual property

Rights of use

Unless otherwise agreed in individual cases, TRAVIS grants you a non-exclusive and non-transferable right to use the content exclusively for your own purposes when using its domains.

The content may never be sold, leased or otherwise transferred to third parties without our express consent. You may not process, translate or delete parts of the documents provided if you do not have our consent or are not legally entitled to do so.

Intellectual property

Independently of the aforementioned conditions in the General Terms and Conditions of Use, information, brand names and other content of our domains to which you do not have any rights may not be changed, copied, reproduced, sold, rented, used, supplemented or used in any other way without the prior written consent of the rightful owner.

In addition to the rights of use expressly granted above, you are not granted any other rights of any kind, in particular to company names and industrial protection rights (patents, utility models, trademarks, etc.), nor is TRAVIS obliged to grant you such rights on the basis of your use.

Liability and warranty

The availability of our domains is only guaranteed within the framework of the technical conditions. Temporary service failures cannot be ruled out and do not constitute a basis for any claims against TRAVIS. Services that are not subject to a special contractual relationship (including the operation of this website and apps) may be suspended at any time without notice.

Please note that data transmission over the Internet (e.g. when communicating by e-mail) has security gaps and cannot be completely protected from access by third parties. If in doubt, choose communication by another non-digital medium.

Liability for content

The content of our domains has been and is carefully prepared and regularly updated. However, we do not assume any liability for the correctness, completeness and up-to-dateness of the content. We are responsible for our own content according to general laws. We are not obliged to monitor third party content on our pages. We shall remove content immediately, as soon as we become aware of a concrete violation of the law that justifies such removal.

The use of the content from our domains is at your own risk; the data only serve as non-binding information and therefore do not relieve you of the obligation to investigate thoroughly when making your own decisions. Therefore, please do not rely on the correctness, completeness and up-to-dateness of the information, if inaccuracies could cause you harm.

Liability for links

The TRAVIS domains may contain links to third party websites (external links). Such websites are the responsibility of their respective operators. TRAVIS disclaims all liability for the content of websites to which it provides links. The relevant links are offered to users of our domains as a service. The decision to use links is made exclusively by website users. Therefore, the setting of external links does not mean that TRAVIS endorses the link or adopts the content behind the link, especially as this content can be changed continuously.

Other liability, liability for malware (viruses)

TRAVIS’ liability for material and legal defects is governed by the aforementioned provisions of these General Terms and Conditions of Use. TRAVIS also excludes its liability for the provision of services, in particular for the downloading of files made available by TRAVIS in the domains listed here.

TRAVIS makes constant efforts to keep its domains and its contents free of harmful software (viruses). Nevertheless, TRAVIS cannot guarantee that the domains and/or their contents are always free of viruses. Therefore, always ensure your own safety with adequate and up-to-date precautions and virus scanners installed, before downloading and accessing content from TRAVIS domains.

The above provisions do not change the burden of proof to your disadvantage.

The content published on the yourtravis.com website – which includes photographs – is subject to copyright. Any use beyond the limits of the applicable copyright law requires the prior written consent of TRAVIS or the owners of the rights (authors). This applies in particular to the reproduction, processing, translation, storage, use, processing or reproduction of content in databases or other electronic media and systems. The unauthorised reproduction or representation of partial content or complete pages is not permitted and may even be punishable. The presentation of this website in external frames is only permitted with the written consent of TRAVIS.

Third party content is marked as such and their copyrights are respected. If you discover content on a page of ours that you suspect is infringing your rights (or those of third parties), please send us an e-mail or contact us. We guarantee you an immediate clarification.

Right to one’s own image when depicting people

The persons depicted on TRAVIS’ web pages have given their consent to the publication of the image on our web pages. If, despite careful checking of the content, a photograph has been published which you consider to be in breach of a principle, or if you wish to remove the published photograph (permitted revocation of consent), you can inform TRAVIS of this in writing (simply by e-mail). Please describe the photo as accurately as possible and indicate on which page it appears.

TRAVIS will immediately remove the photograph(s) from the relevant TRAVIS web pages and will not use them in the future if publication is contrary to the above.

Other, ancillary agreements, applicable law

Persons domiciled in other countries are requested to observe applicable (sales) restrictions for the products and/or services in question. If access to our website is not permitted in accordance with the applicable law in that country, you may not access our domains.

Dutch law applies to all disputes or claims arising from or in connection with these ‘General Terms and Conditions of Use’, or the subject matter or formation thereof (including non-contractual disputes or claims), with the exception of Dutch private international law. The applicability of the Vienna Sales Convention 1980 (CISG) is excluded. The parties irrevocably agree that the court in Breda has exclusive jurisdiction to take cognizance of disputes or claims arising from or in connection with these ‘General Terms and Conditions of Use’, or the subject matter or the formation thereof (including non-contractual disputes or claims).
